These Terms of Use ("Terms") are a legal agreement between you and MSBI Group LLC (doing business as Hopeo) ("we," "our," or "us") governing your use of the MSBI Group LLC (doing business as Hopeo) mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 18 years of age to use the App, which is Puerto Rico's legal drinking age (13 L.P.R.A. ยง 32565). By using the App you represent that you meet this requirement.
You are responsible for the activity that happens under your account and for keeping your Apple ID secure. Choose a username that is not misleading, offensive, or impersonating another person or business. We may reclaim a username that violates this.
The App includes user-generated content (reviews, Community Routes, plans, reports, usernames, and bios). We have zero tolerance for objectionable content and abusive users. You agree not to post content that is unlawful, hateful, harassing, threatening, sexually explicit, defamatory, or that promotes drunk driving or underage drinking; not to impersonate anyone; not to spam or advertise without our permission; and not to submit false venue information or fraudulent check-ins.
You can report objectionable content or a user from within the App. We review reports and remove violating content, and we may suspend or permanently remove offending users, ordinarily within 24 hours of a report. We may remove content or terminate accounts at our discretion for violations of these Terms.
You may not post photographs or videos in which anyone under 18 appears alongside alcohol, and we will remove such content (Puerto Rico Act 204-1998).
You keep ownership of the content you create. By posting it in the App you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it within the App and in our promotion of the App. You are responsible for having the rights to anything you post, including photos.
Check-ins require your device to confirm you are physically at the venue. Attempting to falsify a check-in โ by spoofing location or any other means โ is a violation of these Terms and may result in loss of badges, passport progress, or your account.
Happy hour times, prices, and venue hours change without notice, and we cannot guarantee that any listing is current. A verified badge means a member of our team confirmed that information in person on the date shown; it is not a promise that the venue will honor it. Always confirm with the venue. We are not responsible for a venue's decisions, pricing, availability, service, or conduct. Your dealings with any venue are solely between you and that venue.
The App promotes discovery of licensed venues, not excessive consumption. Never drink and drive. You are solely responsible for your own conduct and safety, including how you travel between venues on a route.
You assume the risk of your own consumption and travel. Hopeo does not sell, serve, or supply alcohol and is not responsible for how much you drink, how you travel between venues, or what happens at a venue. Routes are suggestions of places, not a schedule of drinks; you decide whether to drink at any stop and how to get home. A check-in means you were there, not that you drank. Never drive after drinking. If you are impaired, use a taxi, a rideshare, or a designated driver.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, MSBI Group LLC (doing business as Hopeo) is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the App or your visit to any venue. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
You may stop using the App and delete your account at any time from within the App. We may suspend or terminate your access for violation of these Terms. Sections T5, T7, T9, and T11 survive termination.
These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable United States federal law, without regard to conflict-of-law rules.
We may update these Terms. We will revise the Effective Date above and, for material changes, notify you in the App. Continued use after changes take effect constitutes acceptance.

We respect copyright. If you believe content in the App infringes your copyright, send a notice under 17 U.S.C. ยง512(c)(3) to our designated agent: MSBI Group LLC, Attn: DMCA Agent, prhopeo@gmail.com. Your notice must identify the work, identify the material and where it appears in the App, give your contact information, and include statements of good-faith belief and of accuracy under penalty of perjury. We remove infringing material and terminate repeat infringers.
MSBI Group LLC (doing business as Hopeo) ("we," "our," or "us") operates the MSBI Group LLC (doing business as Hopeo) mobile application (the "App"), a happy hour and craft beer guide for Puerto Rico. This Privacy Policy explains what information we collect, why we collect it, who processes it on our behalf, and the choices you have.
Hopeo is a connected app. To sign you in, verify that you are a Puerto Rico local, manage your subscription, publish what you choose to share with other users, and keep the catalog current, we collect information and store it on servers operated by our service providers. This replaces an earlier version of this policy that described Hopeo as storing everything only on your device.
Some things still never leave your iPhone โ your check-ins, your badges and passport progress, and the routes you build for yourself. Section 2.5 lists exactly what stays local and what does not, and Section 2.4 explains what happens to your location.
By downloading or using the App, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.
Hopeo uses Sign in with Apple. Apple gives us a unique identifier for your account and, only if you choose to share it, your name โ which becomes your initial display name. We do not request or store your email address. The identifier is stored on your device and is attached to the content you publish (see 2.5), so your posts stay yours. We do not keep a separate user profile on our servers.
We store the profile you create in the App: your username, display name, optional bio, your access tier (Local, Visitor, or Guest), and the taste preferences you select during setup. Your username is public to other users wherever your activity appears โ for example on Community Routes and reviews.
Free local access requires confirming a Puerto Rico phone number. When you request a code, we send your phone number to Twilio, which generates and delivers the SMS and checks the code you enter. We keep a record linking an opaque challenge identifier to that number only while the code is pending, so the App never has to transmit the raw number a second time; that record is deleted as soon as you verify, and in any case within 24 hours. To limit how often codes can be requested we keep a salted one-way hash of the number for up to one hour; it cannot be reversed to recover your number. We use the number only to confirm a Puerto Rico area code. We do not use it for marketing and we do not send you SMS messages other than the verification code.
The App asks for location permission to:
Your location never leaves your device. When you complete a check-in, your device uses your coordinates to confirm you are actually at the venue, and the check-in record โ coordinates included โ is stored only in the App on your iPhone. We do not receive it, we do not continuously track or log your movements, and we do not build advertising profiles from your location. You can revoke location access at any time in iOS Settings; the map and nearby features will stop working, but the rest of the App continues to function.
These never leave your iPhone. We do not receive them, they are not backed up to us, and they are gone if you delete the App:

Subscriptions are sold through Apple's In-App Purchase system. Apple processes your payment; we never see or receive your card details. We use RevenueCat to track whether your subscription is active, which involves sharing an app-specific user identifier and your purchase status with them.
We use Google Firebase Analytics and PostHog to understand how the App is used so we can improve it. PostHog receives a randomly generated identifier that is not linked to your name, your Apple account, or your email address. This records events such as opening a venue, tapping or saving a deal, completing a check-in, starting a route, viewing the paywall, and completing a purchase, along with your access tier. Firebase Analytics also collects standard device and app information (such as device model, operating system version, app version, an Apple-provided vendor identifier, and coarse region). We also use Firebase Crashlytics to receive automatic reports when the App crashes; these contain device and app state, not the content you create, and expire after 90 days. We do not use this data for advertising and we do not sell it.
We use Firebase App Check to confirm that requests to our servers come from a genuine copy of the App rather than an automated script.
If you email us for support, we receive whatever you send us (such as your email address and a description of the issue) and use it solely to respond.
We do not sell your personal information, and we do not share it with advertisers or data brokers.
We do not sell or rent your data. We share it only with the service providers that make the App work, and only for that purpose:
We may also disclose information if required to do so by law, or where necessary to protect the safety of our users.
We keep your account data for as long as your account exists. Phone verification records are deleted when you verify, and in any case within 24 hours.
You can delete your account from within the App (Profile โ Settings). Deleting your account erases your profile, check-ins, saved happy hours, badges, and routes from your device, and resets the identifiers used by our analytics and subscription providers.
Anything you posted publicly โ a community route, a venue review, a hangout plan, a Local Legend or weekly-league entry โ is unlinked from you rather than erased: your name is replaced with "Hopero" and the identifiers that tie the post to you are deleted. The text of a review stays, because other people and the venue rely on it, but nothing in it points back to you. Aggregate figures (for example, a venue's total check-in count) also remain, in a form that no longer identifies you.
Deleting the App from your device alone does not delete your account โ use the in-App deletion, or request it without the App at legal.hopeo.app/eliminar-cuenta (or by emailing prhopeo@gmail.com). We complete deletion within 30 days. Purchase and subscription records are retained by Google Play, Apple and our subscription processor for tax and fraud-prevention purposes; SMS delivery logs are retained by our verification provider under its own retention policy; anonymised crash reports expire after 90 days. None of these can be used to rebuild your account or identify you inside the App.
What deletion does not remove. Your username handle stays reserved so nobody can take it to impersonate you; it no longer points to any profile. Drink boards you shared for a venue remain, without your name. Business-ownership claims you submitted are retained as a record of the verification we performed. Analytics events already recorded may persist in aggregate, no longer tied to an identifier.
Reports are an exception. Reports you file โ including any photo you attached as evidence โ are moderation records, and we retain them after account deletion so we can enforce our Terms and keep a record of the action we took. They are never shown to other users.
Data in transit is encrypted using HTTPS/TLS. Data at rest is stored on Google Cloud infrastructure and protected by its security controls. Access to production data is limited to Hopeo's operators. No system is perfectly secure, and we cannot guarantee absolute security.
MSBI Group LLC (doing business as Hopeo) is intended for users who are 18 years of age or older, which is Puerto Rico's legal drinking age (13 L.P.R.A. ยง 32565). The App is not directed to anyone under the age of 18, and we do not knowingly collect information from them. If you believe a minor has provided us information, contact us and we will delete it.
To exercise any of these rights, contact us using the information in Section 10.
Depending on where you live, you may have the right to know what personal information we hold about you, to correct it, to delete it, and to receive a copy. We do not sell your personal information and we do not share it for cross-context behavioral advertising. Hopeo asks for precise location, which several U.S. states treat as sensitive personal information; we use it only for the purposes in Section 2.4, it never leaves your device, and you can withdraw permission at any time in your device settings. To exercise any right, email prhopeo@gmail.com. We will not discriminate against you for exercising these rights.
If a security breach affects personal information of Puerto Rico residents, we will notify affected users as promptly as possible and file the report required by Puerto Rico Act 111-2005 with the Department of Consumer Affairs (DACO) within ten days of detecting the breach.

The App does not integrate third-party advertising SDKs, and does not use social login providers other than Sign in with Apple.
